GENERAL TERMS AND CONDITIONS ON HAJJ SAVING ACCOUNT
(“General Terms and Conditions”)
I. DEFINITION
In this General Terms and Conditions, the terms beginning with capital letters shall have the following meanings:
1. Hajj Fund Management Agency/Badan Pengelolaan Keuangan Haji (“BPKH”) means an institution appointed by the government of the Republic of Indonesia toperform hajj fund management.
2. Bank means PT Bank Danamon Indonesia Tbk through Sharia Business Unit which has appointed by BPKH as Deposit Recipient Bank – Hajj Administration Cost/Bank Penerima Setoran Biaya Penyelenggaraan Ibadah Haji (BPS BPIH).
3. Cost of Organizing Hajj / Biaya Penyelenggaraan Ibadah Haji (“BPIH”) means a number of funds payable by Indonesian citizens who will perform hajj pilgrimage .
4. Special of Cost of Organizing Hajj /Biaya Penyelenggaraan Ibadah Haji Khusus (“Special BPIH”) means a number of funds payable by Indonesian citizens who will perform special hajj pilgrimage . Special Hajj means a pilgrimage whose implementation is carried out by a special hajj organizer with special management, financing, and services. The organizers of Special Hajj are travel agencies that have received permission from the Minister of Religious Affairs to organize Special Hajj.
5. Hajj Pilgrims means Bank's customers who are Muslim and have registered to perform hajj pilgrimage with the requirements set by the Ministry of Religious Affairs.
6. General Haj Cash means BPKH account with the Bank that is used to receive BPIH and/ or Special BPIH in the context of Hajj Fund management.
7. Hajj Fund means all rights and obligations of the central government that can be valued in money related to organizing of the hajj pilgrimage as well as all wealth in the form of cash or goods that can be valued in money as a result of the performance of these rights and obligations, either originating from the Hajj Pilgrims or other non-binding legal sources.
8. Hajj Pilgrims Saving Account/Rekening Tabungan Jemaah Haji (“RTJH”) means an account opened by the Hajj Pilgrims with the Bank to pay BPIH and/ or Special BPIH deposits.
9. Virtual Account means an account connected to the General Haj Cash provided by BPKH to Hajj Pilgrims as the receiving account number for BPIH and/ or Special BPIH payments.
II. TERMS AND CONDITION OF RTJH
A. General Condition
1. Hajj Pilgrims agrees and hereby declares that the opening of RTJH is subject to this General Terms and Conditions and the General Terms and Conditions of Sharia Banking Accounts and Services.
2. Hajj Pilgrims authorizes the Bank to open RTJH.
3. Hajj Pilgrims shall sign the RTJH opening application by attaching the required documents.
4. Hajj Pilgrims shall fill out and sign the Wakalah Agreement, namely the al-wakalah al-khassah al-muqayyadah contract for the hajj funds managemet that have been deposited by the Hajj Pilgrims to the BPKH.
5. RTJH is opened with a minimum initial deposit requirement of the nominal BPIH deposit and/ or Special BPIH determined by the Ministry of Religious Affairs.
6. The initial deposit of BPIH and/ or Special BPIH is paid through RTJH to be forwarded to the General Haj Cash as one of the conditions to obtain a Virtual Account number
7. RTJH opening and initial deposit of BPIH and/ or Special BPIH is carried out at the Branch Office according to the domicile of the Haj Pilgrims listed on the identity card. The Branch Office is a Bank’s branch that can serve sharia transactions for opening RTJH accounts and initial BPIH and/ or Special BPIH deposits.
8. RTJH opening with an initial deposit in the form of another Bank's slip or remittance through a correspondent bank, will be recorded after the Bank receives the funds in the RTJH.
9. Hajj Pilgrims have read and received sufficient explanation from the Bank regarding the rights of the Hajj pilgrims, as stated in Attachment 1.
B. Virtual Account
1. The Bank will create a Virtual Account for each Hajj Pilgrim.
2. Virtual Account is the identification number of Hajj Pilgrims received from BPKH as the account number to receive the return.
3. Virtual Account is intended so that every Haj Pilgrim can find out the return of BPIH and/ or Special BPIH to which is their rights.
4. The Bank does not charge administration fees for Virtual Account
5. BPKH prepares and determines the terms and conditions for the Virtual Account service.
6. Hajj Pilgrims can access the Virtual Account after agreeing to the terms and conditions defined by BPKH.
7. The payment of the benefit value paid by the Bank to the Virtual Account according to BPKH instructions.
8. Hajj Pilgrims cannot withdraw the deposits balance in BPIH and/ or Special BPIH that recorded in the Virtual Account
9. Hajj Pilgrims cannot withdraw the benefit value that already paid to the Hajj Pilgrim’s Virtual Account.
10. The benefit value as recorded in the Hajj Pilgrim’s Virtual Account will only be paid to RTJH in the event of account closing or refund as stipulated in the regulations set by BPKH from time to time.
C. RTJH Account Closing
1. RTJH can be closed no later than 6 (six) months after the last arrival group of the Haj Pilgrims in Indonesia in the year the Haj Pilgrims perform their hajj pilgrimage.
2. If: (i) After the expiration of the period as stipulated in point (1) above; and (ii) the RTJH has zero balance, the Bank may close the RTJH as long as BPKH has approved the closure.
3. Hajj Pilgrims have the right to close the RTJH account and receive the remaining benefit value of BPIH and/ or Special BPIH as recorded in the Virtual Account by submitting proof of hajj departure issued by the Ministry of Religious Affairs.
4. The closure of the RTJH can also be carried out if the Haj Pilgrims dies or cancels the portion of the haj for other valid reasons as regulated in the provisions of the laws and regulations regarding the Organization of the Hajj.
5. There will be no administration fee for closing RTJH.
6. Refund of the remaining benefit value recorded in the RTJH is carried out based on BPKH instructions and under applicable laws and regulations.
7. If the function of the Bank as BPS BPIH is canceled and/or not extended by BPKH, all funds in the RTJH will be transferred according to the procedure and time specified in the BPKH instructions. The transfer of RTJH, as referred to in this section, is not subject to administrative fees.
III. MISCELLANEOUS
1. Hajj Pilgrims can submit complaints on banking transactions/ services to the Bank through the nearest Branch Office or through Hello Danamon 1-500-090 verbally or in writing to hellodanamon@danamon.co.id
2. In the event of any inconsistency between this General Terms and Conditions and the General Terms and Conditions of Sharia Banking Accounts and Services of PT Bank Danamon Indonesia Tbk, . this General Terms and Conditions will prevail.
3. This General Terms and Conditions have been adjusted to the provisions of laws and regulations, including the provisions of the Financial Services Authority (OJK) regulations
Hajj Pilgrims hereby declare that the Haj Pilgrims have read, understood, understood, and agreed to this General Terms and Conditions before opening RJTH.
Know Your Rights
The Law on Hajj Fund Management (Law Number No 34 of 2014) was issued to ensure the realization of the ideals of Haj Fund management. In addition to regulating the management of BPIH deposits for hajj pilgrims, this Law also regulates DAU and other non-binding legal sources.
Haj Fund Management is carried out in the form of investments whose benefits are used to improve the quality of Haj Pilgrimage organization, rationality, and efficiency of using BPIH, as well as for the benefit of Muslims.
On the other hand, this Law also mandates the Hajj Fund management in accordance with the principles of sharia, prudence, benefits, non-profit, transparent, and accountability.
To manage the Hajj fund, this Law establishes BPKH as a public legal entity that is independent and accountable to the President through the Minister.
BPKH obligations:
1. Managing Hajj Fund in a transparent and accountable manner for the greatest interest of the Hajj Pilgrims and the benefit of Muslims.
2. Providing information through the media regarding performance, financial condition and wealth, and the results of its development on regular basis every 6 (six) months.
3. Providing information to the Hajj Pilgrims regarding the BPIH and/ or Special BPIH return through the Virtual Account for each Hajj Pilgrims.
4. Conducting bookkeeping in accordance with the applicable accounting standards.
5. Reporting the implementation of Haj Fund management periodically every 6 (six) months to the Minister and the House of Representatives/ Dewan Perwakilan Rakyat (DPR).
6. Conducting settlement the return of the BPIH and/ or Special BPIH deposit periodically to the Virtual Account of each Hajj Pilgrim in accordance with the provisions of the legislation.
7. Returning the balance difference between the BPIH and/ or Special BPIH from the determination of the current year's Special BPIH and/or BPIH to the Hajj Pilgrims
Hajj Pilgrims Candidate’s rights
1. Hajj Pilgrims Candidates are entitled to receive a virtual account. What is meant by “virtual account” is a shadow account that is connected to the master account. The virtual account has a BPKH identification number opened by the Bank at the request of BPKH to be further provided by BPKH to the Hajj pilgrims as the account number to receive the benefit value.
2. Hajj Pilgrims Candidates are entitled to receive the benefit value of the obtained from the results of the development of Hajj Fund.
3. In the event that the balance of the BPIH deposit is more greater than the determination of the current year's BPIH, the Hajj Pilgrims Candidates shall be entitled to a refund of the difference.
4. Hajj Pilgrims Candidates (or the legal heirs of the hajj pilgrims candidates) are entitled to receive a refund of the BPIH deposit balance if the Hajj Pilgrims Candidates cancel their portion either due to death or other valid reasons as stipulated in the provisions of the laws and regulations regarding the Organization of the Hajj.

1. Deposits of BPIH and/ or Special BPIH are entrusted funds of the Hajj Pilgrims for the Hajj Pilgrimage Organization. Hajj Pilgrims’s entrusted fund are funds that are not recorded in the state revenue and expenditure budget
2. BPIH and/or Special BPIH deposits are paid to an account in the name of BPKH in its position as the legal representative of the Hajj Pilgrims at the Hajj Cash through BPS BPIH. What is meant by "in the position of BPKH as a legitimate representative of the Hajj Pilgrims" is that it can use the term Qualitate Qua or "qq" so that the account in the name of BPKH in its position as the legal representative of the Hajj Pilgrims in banking can be shortened to "account a.n. BPKH qq Hajj Pilgrims".
3. Hajj Fund Management is based on: sharia principles; the precautionary principle; benefits; non-profit; transparent; and accountability:
a. What is meant by the "benefit" principle is that the Hajj Fund magement shall be able to provide benefits or social benefits for the Hajj Pilgrims and Muslims.
b. What is meant by the "non-profit" principle, that the Hajj Financial management is carried out through business management that prioritizes the use of the fund development proceeds to provide maximum benefit for the Hajj Pilgrims and social benefit of Muslims, without dividend distribution for its manager.
c. What is meant by the "transparent" principle is that the Hajj Fund management must be carried out openly and honestly by providing material information to the public, especially to the Hajj Pilgrims, regarding the implementation and results of the Hajj Fund management.
d. What is meant by the "accountable" principle, it is carried out accurately and can be accounted for to the public, especially to the Hajj Pilgrims
4. Members of the executive board and members of the supervisory board are jointly and severally responsible for losses on the placement and/or investment of Hajj Fund in its entirety resulting from errors and/or negligence in its management.
5. Supervision of BPKH is carried out internally and externally. BPKH's internal supervision is carried out by the supervisory board. External supervision of BPKH is carried out by the DPR based on the audit results of the Audit Board of Indonesia/ Badan Pemeriksa Keungan (BPK).
6. At the end of the term of office, members of the executive board and members of the supervisory board are required to submit an accountability report for the implementation of their duties to the President and DPR
7. All deposits that Hajj Pilgrims have paid to BPKH are guaranteed by the Government of the Republic of Indonesia
